1. Acceptance of terms
By accessing or using flush. ("the Service") at doyouflush.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users including regular users, business account holders, and visitors.
2. Description of service
flush. is a crowdsourced restroom rating and discovery platform. Users can find, review, and rate public restrooms, upload photos, and contribute location data. Business owners can claim and manage their restroom listings. flush. provides this information as a community service and does not guarantee the accuracy of any user-submitted content.
3. User accounts
You must create an account to submit reviews, add restrooms, or claim business listings. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. You may not create accounts for others or use another person's account without permission.
4. User content
By submitting reviews, photos, or restroom information, you grant flush. a non-exclusive, worldwide, royalty-free license to display, distribute, and use that content on the platform. You represent that you have the right to submit the content and that it does not violate any third party rights. You retain ownership of your content. We reserve the right to remove content that violates these terms or our community guidelines.
5. Community guidelines
You agree not to submit content that is false or misleading, harassing, threatening, or abusive, sexually explicit or inappropriate, spam or commercial solicitation, or content that violates any applicable law. Reviews must be based on genuine first-hand experiences. Businesses may not submit fake reviews for their own or competitors' listings. Violations may result in account suspension or termination.
6. Business accounts and sponsorships
Business owners may claim ownership of restroom listings subject to verification and approval by flush. administrators. Sponsored listing fees are charged on a recurring monthly basis. Cancellation takes effect at the end of the current billing period. flush. reserves the right to revoke sponsored status for violations of these terms. Refunds are not provided for partial billing periods.
7. Accuracy of information
flush. does not guarantee the accuracy, completeness, or reliability of any user-submitted content including restroom ratings, cleanliness scores, hours of operation, or accessibility information. Always verify restroom availability and conditions independently when necessary. flush. is not responsible for any inconvenience caused by inaccurate information on the platform.
8. Intellectual property
The flush. name, logo, app design, and original content are owned by flush. and protected by applicable intellectual property laws. You may not use the flush. name or logo without prior written permission. User-submitted content remains the property of the respective users subject to the license granted in Section 4.
9. Disclaimer of warranties
The Service is provided "as is" without warranties of any kind, either express or implied. flush. does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. Your use of the Service is at your sole risk.
10. Limitation of liability
To the maximum extent permitted by law, flush. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to reliance on restroom information, inability to access the Service, or unauthorized access to your account.
11. Termination
We reserve the right to suspend or terminate your account at any time for violations of these terms or for any other reason at our discretion. You may terminate your account at any time by contacting us at hello@doyouflush.com. Upon termination, your right to use the Service ceases immediately.
12. Changes to terms
We may modify these terms at any time. We will notify users of significant changes via email or in-app notice. Continued use of the Service after changes constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of California.
